Abstract

Przedmiotowa monografia opisuje zagadnienie kryminalizacji czynu zabronionego, polegającego na seksualnym wykorzystywaniu nieletnich poniżej piętnastego roku życia – zarówno w aspekcie obecnie obowiązujących rozwiązań, jak i od strony historycznej. Niniejsze opracowanie zwraca uwagę na fakt, iż współczesna typizacja pedofilii w rodzimym porządku normatywnym bierze pod uwagę ujęcie cybernetyczne, gdzie nawiązanie kontaktu pomiędzy sprawcą a ofiarą ma miejsce poprzez zastosowanie sieci telekomunikacyjnej. Ponadto omawiana praca porusza problemy między innymi: granicy wieku, poniżej której następuje kryminalizacja czynności seksualnej z małoletnim oraz elementów kondycji psychicznej przestępcy i pokrzywdzonego. Występują tu także postulaty de lege ferenda w omawianym zakresie. 

This monograph describes the issue of criminalisation of the offence of sexual abuse of minors under the age of fifteen - both from the perspective of current solutions and from the historical perspective. This study draws attention to the fact that the contemporary typification of paedophilia in the domestic normative order takes into account the cybernetic approach, where contact between the perpetrator and the victim is established through the use of telecommunication networks. In addition, the work in question raises the issues of, inter alia: the age limit below which sexual activity with a minor is criminalised and elements of the psychological condition of the offender and the victim. There are also de lege ferenda postulates in the discussed area.
