Abstract

Polski ustawodawca opublikował w połowie września 2021 r. na stronie Rządowego Centrum Legislacji projekt gruntownej zmiany – między innymi – Kodeksu karnego. W dniu 7 lipca 2022 r. Sejm RP przyjął ww. projekt ustawy (druk sejmowy nr 2024). W zasadniczym stopniu nowelizacja - między innymi - zwiększa wysokość kar grożących za poszczególne przestępstwa. Ustawodawca – poprzez zabiegi legislacyjne – wskazuje które przestępstwa są dla niego szczególnie istotne z punktu widzenia dóbr chronionych. Wydaje się, że konsultacje publiczne i szerokie opiniowanie mogłyby pozwolić na wypracowanie wyważonego stanowiska służącego dobru – możliwie jak najszerszej liczby – obywateli; tego typu działania przyczynią się wówczas do sformułowania sankcji optymalnej, której to zidentyfikowanie i stosowanie przysłuży się szerokiemu spectrum zainteresowanych.

In mid-September 2021, the Polish legislator published on the website of the Government Legislation Center a draft of a thorough change - among others - of the Penal Code. On July 7, 2022, the Sejm of the Republic of Poland adopted the above-mentioned bill (Sejm print no. 2024). Essentially, the amendment - among other things - increases the height penalties for individual crimes. The legislator - through legislative measures - indicates which crimes are particularly important for him from the point of view of protected goods. It seems that public consultations and wide-ranging opinions could allow to work out a balanced position serving the good of - as many as possible - citizens; such actions will then contribute to the formulation of the optimal sanction, the identification and application of which will benefit a wide spectrum of interested parties.
