Abstract
Given the complexity of modern data processing, individuals often do not know to whom controllers provide the information collected about them. In the commented judgment, the Court ruled that the controller is bound by the data subjects’ request to access information about the identity of the specific recipients of their data and has limited ability to provide them with information about the categories of recipients. This interpretation of the Court not only strengthens the position of data subjects vis-à-vis controllers but also clarifies the relationship of Article 15(1)(c) of the GDPR with similar-sounding requirements obliging controllers at the stage of data acquisition to provide information about recipients or categories of recipients (Articles 13(1)(e) and 14(1)(e) of the GDPR). However, in the judgement’s statement of reasons, the Court fails to analyse elements of significant importance for fulfilling a data subject access request. The author of the commentary analyses the Court’s judgment and its consequences for interpreting the right of individuals to obtain information about recipients or categories of recipients of their data.
